Evan Richman sought and obtained dismissal of a Disability Discrimination Complaint from New York State Division of Human Rights (“DHR”). The DHR issued a Determination and Order which found that there was no merit to Complainant’s claim of disability discrimination stemming from the Respondents’ inability to transfer Complainant to another apartment as a reasonable accommodation. The DHR concluded that Respondents were unable to transfer Complainant because no such alternate apartments were currently available and because Complainant was previously offered and refused other such apartments in the past. The DHR further concluded that the documentary evidence established that Respondents had assisted Complainant at all times in searching for alternate available housing. The DHR thereby concluded that the record did not support any inference of either discrimination or retaliation and the DHR dismissed the Complaint.
