Partner, James P. Ricciardi, Jr., obtained summary judgment in a claim arising out of a commercial trucking accident resulting in a violent explosion and significant injuries.  The accident occurred when Co-Defendant changed lanes, collided with our Client’s truck and then careened into a gas station. Co-Defendant’s vehicle struck a gas pump from which Plaintiff was fueling his vehicle resulting in an explosive fire in the gas station.  Initially, the Co-Defendant contended that our Client accelerated as he tried to change lanes, thereby contributing to the accident, but through diligent investigation and discovery efforts, notably the acquisition and use of police officer’s body cam from the scene, the Co-Defendant all but admitted fault for the accident. Through this evidence, coupled with the admissions garnered from our questioning during the pre-trial deposition of Co-Defendant, we successfully obtained an Order finding that our Client was not at fault for the accident, vindicating our Client’s position as to how the accident occurred.
