Partner Stuart Glass spearheads a multi-million dollar labor law settlement with minimal impact to our client, a general contractor
In a recent Labor Law case, Stuart Glass took the lead in negotiating a $19 million dollar global settlement of which our client contributed 1.32% ($250,000). This case involved catastrophic injuries that resulted from a 650 pound beam falling from an elevation onto the plaintiff in the course of his employ. This settlement was reached on the eve of a defendants’ only trial for apportionment of liability to be followed by the damages trial. Of import is that plaintiff had obtained a summary judgment order on liability against our client based on Labor Law Section 240, but in negotiating the settlement Mr. Glass focused on issues of contractual indemnification, agency and the pass through of liability as against multiple subcontractors. What made this settlement even more of a victory for our client is that the subcontractors, who contributed the vast majority of the settlement monies, were facing erosion issues on their respective policies that were in play in a separate claim within the same policy periods. Mr. Glass was steering this case since its inception and his initial case evaluation rang true at the conclusion of the settlement negotiations and took the lead in the negotiations.
